Felony & Misdemeanor Expungements
GETTING A FRESH START WITH AN EXPUNGEMENT
A criminal conviction can have long-lasting effects on your future. It can prevent you from securing a job, a house or some forms of financial assistance. For some, expungements can truly give people a second chance, allowing them to get their lives back on track.
Getting a felony or misdemeanor expungement, however, can be a complicated process, and an error can mean a conviction stays on your record when it does not need to. At Prince & Brien, P.S.C., Marshall County, Kentucky's most experienced law firm, our criminal defense attorneys can guide you through the process. We stay on top of changes to the law to put you in the best position for a successful outcome.
Understanding Changes to Kentucky's Expungement Laws and Your Eligibility
Kentucky law now allows for not just misdemeanors, but 61 types of Class D felony convictions to be expunged from your record. These new expungement-eligible offenses include:
Possession of a controlled substance, first degree for cocaine, methamphetamine and LSD
Marijuana cultivation
Several prescription drug-related offenses
Theft-related offenses
Failure to pay child support
Several gambling-related offenses
For a Class D felony, you must complete your sentence and then wait five years before applying. To apply, you will need to file the proper paperwork and pay applicable fees. If the prosecutor's office objects, a judge may order a hearing. If this happens, it will be important to work with experienced attorneys like ours who have in-depth knowledge of prosecution and defense strategies.
